Beneficiaries of Indemnities and Severance Pay in the Event of the Domestic Worker's Death

This article of the National Collective Labor Agreement for Domestic Work establishes the methods for paying notice compensation and the End-of-Service Allowance (T.F.R.) in the event of the worker's death.

These benefits must be provided to the surviving spouse, children, or, in their absence, relatives up to the third degree and in-laws up to the second degree who were financially dependent on the worker. If there is no agreement among the entitled parties regarding the distribution of the sums, this will be determined in accordance with the current legal regulations.

If there are no survivors among the indicated individuals, the allowances will be assigned according to the provisions of testamentary or legitimate succession. These provisions ensure that the rights accrued by the deceased domestic worker are transferred to their family members or legitimate heirs, providing them with financial support in times of need.

Art.42 Indemnity in the event of death

1. In the event of the worker's death, the notice allowances and the T.F.R. must be paid to the spouse, children, or, if they were dependent on the worker, relatives up to the 3rd degree and relatives by marriage up to the 2nd degree.

2. The distribution of the allowances and the T.F.R., if there is no agreement among the entitled parties, must be done according to legal regulations.

3. In the absence of the aforementioned survivors, the allowances are allocated according to the rules of testamentary and legitimate succession.
